Conviction for Centrelink fraud is not inevitable!
Date: May 15, 2008

LAC Lawyers was consulted by a young person who had been charged with obtaining over $6,000.00 from the Centrelink by deception. Centrelink fraud is a serious criminal offence and persons convicted of it are at risk of going to gaol. My client was paid the youth allowance while she was a student and had failed to properly disclose her income from a part time job. On our advice, we pleaded not guilty to all charges. On careful analysis of the prosecution case it was clear that my client had never made a false or misleading statement to the Centrelink concerning work or her income. Our client also gave evidence. The magistrate was satisfied that our client's failure to disclose her income was inadvertent and not done deliberately to obtain the additional payments. All charges were dismissed.

We recently finalised a matter for a client (“Mr. A”) who was charged with a set of drug charges: possession and dealing with heroin and amphetamines worth $65,000. Mr. A had a prior criminal record for similar offences and a conviction would have definitely resulted in a term of immediate imprisonment of at least 2 years.
