Criminal Law - Child Abduction

Abduction is defined as the unauthorised removal of a minor from the custody of the child’s natural or legally appointed guardians.

Australia is party to the Hague Convention, an international agency that battles the prevention and eradication of child abduction. The Hague Convention is a multilateral legal treaty signed by Australia, as well as many Asian countries, European countries and the US in which they agreed to assist one another when possible child abduction may arise.

How do I know if my ex is planning to abduct our child?

If one or more of the following circumstances are relevant to you, you should contact LAC Family Lawyers for immediate advice.

  • the other parent is planning to a trip outside Australia with the child;
  • your ex-spouse is coming from abroad to Australia and you believe that your ex-spouse will abduct the child;
  • the other parent has a home, family or other connections abroad and there is no reason for them to stay in Australia;
  • the other parent has no property or employment in Australia, and has no reason to stay in Australia.

What can I do?

The first thing you should do is contact LAC Family Lawyers and seek immediate legal advice. A parent can apply for a location order associating the child. A location order is an order made by a court that places an obligation on a person to give information about a child’s location to the court. People who can apply for a location order are.

  • a person who a child is to live with, in accordance with a parenting order;
  • a person who a child is to spend time with, in accordance with a parenting order;
  • a person who a child is to communicate with, in accordance with a parenting order;
  • a person who has parental responsibility for a child under a parenting order;
  • a grandparent of a child;
  • any other person concerned with the care, welfare and development of a child.

What do I do if my child has been abducted?

  • Reporting the child as missing to a local law enforcement authority.
  • Contacting the Australian Federal Police and obtain information in respect of the airport departure and arrival details of the child.
  • If the child has been taken to a Hague Convention member country or a country in a bilateral agreement with Australia, contacting the relevant foreign Central Authority;
  • Seeking help from Overseas (Child Custody Removal) Scheme, to assist a parent with their legal expenses abroad.
