Mr S attended a conference with me and instructed me that he was very concerned as his wife had travelled to Sydney, with their 2 year old daughter (who had a passport), several days ago, and had not contacted him since, nor returned his telephone messages. He was concerned as his wife had previously indicated she was not happy in Australia and was considering going back to her home country to live. Immediately upon receiving instructions, an Application for an urgent Watchlist Order, as well as a very comprehensive Affidavit, were drafted on Mr S’s behalf. A barrister was also briefed immediately. The next morning, the documents were filed at the Federal Magistrates Court, the matter was heard by a Federal Magistrate, and Interim Watchlist Orders were granted, stopping Mrs S from taking her child outside the Commonwealth of Australia. Mr S was very relieved.
