Serious Criminal Charges
Date: May 15, 2008
Authors: Michael Pickering B.A., LL.B. (Hons.), LL.M., M. A.
Client A approached LAC Lawyers Melbourne. He had worked as a prison warden for a busy prison in central Melbourne where some of the State's most violent and hardened criminals are in custody on remand awaiting appearances at the Melbourne Magistrates' Court.
Client A was charged with perverting the course of justice and with manufacturing and using a false report with the intention of preventing an assault on a prisoner in the care and control of Client A from being provided to the Victoria Police. These charges carry possible prison sentences of up to 15 years.
After advice, Client A pleaded guilty. Michael Pickering prepared the documents used in the plea for mitigation of sentence including numerous character witnesses from former and current serving police and prison offices.
As a result, the County Court did not impose a custodial sentence on Client A but sentenced him to an Intensive Correction Order for nine months.
