Strata Title Law - The Intricacies of Strata Living

Many people are not aware that when they purchase a Strata Title they “own”, in the absolute sense is the cubic space within the inner surface of the walls so when you purchase your strata title property, you automatically acquire the unit entitlement applicable to your particular unit. The rest of the property (“Common Property”) is owned by a body called The Owner’s Corporation (the “Body Corporate”).
Generally speaking, Individual owners need to approach the Owners Corporation in order to have the by-laws amended.
The Owners Corporation can change existing by-laws, or create new ones, for the better administration and the smooth running of the strata scheme. Most by-laws can be changed or created by special resolution passed at a duly convened general meeting of the Owners Corporation. They generally cover the use of common property and the behavior of residents but can also deal with many other aspects of the scheme.
By-laws usually prelate to:
- Architectural and landscaping guidelines installation of pergolas and other amenities by individual owners;
- Behavior of residents including emission of noise, hanging of washing on the balcony etc;
- Installation and use of Floor coverings;
- Installation and use of Air conditioners, T.V & Satellite Dishes;
- Keeping of pets;
- Parking restrictions and use of allocated areas;
- Security and Safety measures;
- Use of facilities and common property;
- Waste disposal.
Before making any changes to your Strata Unit, you should consider getting legal advice. Sometimes you might need to get legal advice to enforce an exiting by-law or have one amended.
