Q. I have heard about setting up my own superannuation fund.  Is this a good idea?

A. Your lawyer can advise you whether your situation justifies having your own superannuation fund.  In order to obtain the benefits flowing from this the fund must be a complying fund.

Q. I have been told I can buy all types of property with my superannuation fund.  Is this true?

A. No.  There are several restrictions placed on this and you need to seek independent legal advice as a result.

Q. As part of my family law settlement my ex-partner wants me to take part of his/her superannuation fund.  Should I do this?

A. This depends on your needs and a lawyer can advise you on your options with respect to a property settlement.  Any superannuation splitting should only be done by your lawyer pursuant to a financial agreement or orders.
