Tax Law - Project Wickenby - Prosecutions and Amount Recovered (Part 2)

More than half of the revenue collected by Project Wickenby came from voluntary disclosures. The majority of the remaining amounts ($276M) was collected through prosecutions and court judgments. As of the date of this writing, 62 individuals have been charged with serious offences under Project Wickenby. Of these, 20 have been convicted. The courts emphasized the following when making their judgments:

  • The amount of revenue lost in respect to the offence committed;

  • The conduct of the entity and the effect to which it calculated whether the offences were planned and premeditated;

  • Where the offences committed were due to greed and not need.

In addition, 65 entities have been prosecuted for summary tax offences with the majority involving outstanding lodgments. Aside from an entity incurring penalties and charges it may also be sentenced up to 12 months imprisonment for lodgment offences.

The ACC (Australian Crimes Commission) and the AFP (Australian Federal Police) lead Project Wickenby in these investigations and provide the majority of intelligence to ground convictions.

Civil Audits and Risk Reviews

Since 2006 Project Wickenby has:

  • Made 98 access visits with notice

  • Made 77 access visits without notice

  • Issued 2,763 notices to acquire relevant information on an entity’s possible involvement in tax havens;

  • Issued 258 notices to “attend and give” evidence in interviews;

  • Issued 2,008 notices of tax assessment

  • Issued 23 DPOs (departure prohibition orders)

Criminal Investigations

As part of Project Wickenby agencies such as the ACC, AFP and ASIC (Australian Securities and Crime Commission) are tasked with conducting criminal investigations including an entity’s involvement in abusive international tax schemes in addition to the methods used by promoters to conceal income through tax or secrecy havens.

In co-operation with the other branches of the project, the ACC, AFP and ASIC have:

  • Issued 472 notices to acquire evidence

  • Issued 383 summonses
  • Issued 83 notices under “proceeds of crime” provisions

  • Completed 433 examinations

  • Executed 379 search warrants

  • Conducted 131 interviews

Conclusion

This did not occur in any of the matters in which we were involved. These matters are expensive enough without running the gauntlet of devices available to these agencies which rarely prove productive to the taxpayer and exposes them to paying the maximum in tax, penalties and interest whilst subjecting themselves to criminal prosecution.
