Tax Prosectuions in the September Quarter 2010

Seventeen offences resulted in custodial terms ranging from 8 months to 7 years during this quarter. The Tax Office is trying to demonstrate that where taxpayers cheat the tax system the risk is not worth it. The message is that the ATO is continuing to expand its ability to detect, deter and deal with those who do the wrong thing in order to protect the revenue. The message is in the gesture that where you are tax non-compliant you will either be fined and/or otherwise penalised and referred where serious offences are detected. As nearly 400 people were convicted of Taxation and Superannuation offences this quarter why would anyone want to be one of them ending up with a criminal record including restricting their right to travel overseas.

Tax Prosecutions for September Quarter

A number of offences were prosecuted ranging from fraud and tax evasion including GST, excise, refund fraud, dealing in the cash economy, deliberately concealing income and operating as an unregistered tax agent as we have seen earlier. A short summary of some of these matters is included below:

  • A NSW man pleaded guilty to charges relating to round-robin tax fraud and money laundering schemes investigated by Project Wickenby which resulted in fraud of $180,464 for which he was sentenced to 2.5 years gaol with a non-parole period of 15 months.
  • A NSW woman was sentenced to 2 years gaol but was released on a 2 year good behavior bond after pleading guilty to two offences concerning her involvement in a round robin scheme investigated by Project Wickenby.
  • A Victorian man sentenced to 7.5 years with a non-parole period of 5 years was ordered to make reparation for more than $4.9M when he was found guilty of lodging over 180 false BASs for entities controlled by him and refunds received for the amount of reparation ordered.
  • A NSW woman was sentenced to 6.5 years with a non-parole period of 4 years when she was found guilty of failing to comply with GST laws, failing to declare income and dishonestly causing a risk of loss to the Commonwealth. She ran a cash sales fake clothing business and failed to lodge income tax returns for over $3M of income and failed to submit BASs for almost $9M of GST.
  • A South Australian woman was sentenced to 3.5 years with a non-parole period of 15 months when she was found guilty of lodging multiple false claims under the diesel fuel rebates and energy grants credit scheme for which she illegally obtained rebates for $130,000.
  • A NSW man was sentenced to 4.5 years with a non-parole period of 3 years and ordered to pay reparation of $290,000 when he was found guilty of submitting false BASs in the names of four non-existent entities to illegally obtain GST refunds amounting to over $290,000 whilst unsuccessfully trying to obtain a further amount of approximately $100,000. Sydney District Court was not impressed because he had attempted to conceal his activities by transferring funds between various accounts providing false tax invoices whilst trying to avoid a tax audit whilst he was on parole for prior state fraud convictions.
  • An American was sentenced to 8 months with a 3 month non-parole period whilst illegally residing in Australia when found guilty in Queensland of using aliases to conceal his identity whilst failing to report income of over $185,000.

Project Wickenby is a multi-agency taskforce across all levels of government involving the ATO, AFP, ACC, ASIC & CDPP supported by Austrac, the Australia Government Solicitor (AGS) and Attorney General’s Department (AG’s).

Tax Prosecution Consequences
