Your Will Last Will and Testament (Will) is your final legally binding communication to the world including those you love. You should ensure that expression is tailored to meet the whole of your circumstances. While Wills’ Kits may permit you to record the basic information about whom you wish to appoint as your Executor and Trustee, and whom is to benefit from your Estate, those kits cannot provide you with the necessary advice you require for making your Will.

The legal view of the Will is that it is your opportunity to communicate to those who morally and financially depend on you, about how you want your estate to be administered and distributed. A Wills’ Kit cannot advise you about the potential pitfalls of an inadequately, or incorrectly, drafted Will.

Aside from legal challenges and related costs, it is important to ensure your Will is written in a manner that properly directs your Executor(s) and Trustee(s) to implement your instructions and which reduces the chance of acrimonious disputes within your family and intimates after your death. A Wills’ Kit will not provide advice about what is required for this process, nor will it direct you to consider the facts and matters specific to your estate. While a Wills’ Kit will invite you to make declarations about the disposal of your body and/or funeral, it cannot inform you about the Executor’s role in implementing those requests. LAC Lawyers will provide you with authoritative advice on these matters to guide you through the potential pitfalls of Will-making and Estate Planning.
