All too often people forget that their major assets are tied up in property whether it be a home/s or commercial and industrial real estate. In an endeavour to save on fees there has been a movement towards conveyancers in the residential property market. Fees have dropped to such an extent that one needs to ask the question, how can they do it for the price whilst providing the requisite care and skill to fully protect either vendor or purchaser? After all, conveyancing is all about title and if that is not properly transferred then the costs likely to be incurred to rectify the situation will be very substantial indeed. From our point of view conveyancing fees are uneconomic which must signify that the standard of work delivered is much less than what it should be, potentially leaving clients at risk.
Interestingly we act for a number of clients who prefer security to risk and who place a value on the completion of any property transaction. Currently we advise clients on the sale and purchase of commercial, industrial and residential properties including advising on contracts, drafting contracts, negotiating amendments, attending to exchange of contracts, attending to post-exchange and pre-settlement work including arranging releases of encumbrances or attending to mortgagees’ requirements, arranging settlement with other solicitors and mortgagees. Apart from this we act for landlords leasing commercial and retail properties where we are required to draft leases, attend to stamping, obtain the mortgagee’s consent, register leases and act for tenants of these properties whilst advising and negotiating amendments. We are also engaged to act for clients on the creation of easements by drafting agreements including various covenants and to protect clients’ interests by lodging caveats where appropriate.
We act for clients by preparing loan agreements secured by mortgages over properties and the lodging of caveats in respect of unregistered mortgages. We also act for clients in respect of partitions and transfers, stamp duty, valuations, FIRB applications, transfers to related parties, applications for new certificates of title and notices of death amongst others. A disposition of property takes care and skill and a lack of care may not be identified for years until a dealing is entered into which will culminate in a transfer.
