DUI
In Victoria, drink driving charges are referred to as Driving under the Influence, or DUI. The penalties for DUI are some of the toughest drink driving penalties in Australia and can result in heavy fines and loss of licence and, for the most serious offenders, possible imprisonment.
To be charged with DUI, a driver has to register a Blood Alcohol Concentration (BAC) of 0.05 grams (or more) of alcohol in 100 millilitres of blood. Professional drivers, probationary and learner drivers, and people who have previously been charged with DUI or any drink driving offence - have a BAC limit of zero.
This page outlines the charge of DUI – Driving under the Influence, disqualification periods and how LAC Lawyers can help in getting the best possible outcome. To speak with an experienced DUI Lawyer in Melbourne, call 1300 734 638.
License disqualification periods for DUI:
Unless the driver successfully defends the DUI charge, his license will be suspended for a period of time based on a number of factors, including:
- Blood Alcohol Concentration (BAC)
- Type of license held (Learner, Provisional, Professional)
- First offence or subsequent offence
Authorities can immediately suspend your licence or in certain situations such as full licence holders with a BAC of .10 or more, and repeat offenders. This suspension may continue until the matter is heard in court.
