Domestic AVO
An Apprehended Domestic Violence Orders (ADVOs) is primarily made when there exists a domestic relationship between the victim and the defendant.
i) Definition of domestic relationship
A domestic relationship includes the following:
- A current or former spouse; or
- A current or former defacto partner; or
- Where you have had an intimate relationship with the victim; or
- Where you live or lived with the victim; or
- Where you are or have been a relative of the victim.
Please note that same sex relationships are also covered within this definition.
ii) Definition of relative
A relative includes the following:
- a father, mother, grandmother, grandfather, step-father, step-mother, father-in-law or mother-in-law;
- a son, daughter, grandson, grand-daughter, step-son, step-daughter, son-in-law or daughter-in-law;
- a brother, sister, half-brother, half-sister, brother-in-law or sister-in-law;
- an uncle, aunt, uncle-in-law or aunt-in-law;
- nephew or niece; and
- Cousin.

If you have been charged with stalking, it is a serious criminal offence and carries a maximum penalty of 10 years imprisonment. A defence available to you in criminal proceedings for stalking or a personal safety intervention order is that the court is required to be satisfied on the balance of probabilities that the person has engaged in a course of conduct without malice.

The vast majority of the AVOs and PVOs are settled after negotiations and the application can either be withdrawn and dismissed, or an undertaking made not to embark on any form of specified behaviour without admissions, or with an order being made with the consent of both parties with no admissions as to the nature of the facts alleged in the application for an order.

Often I am asked by my clients who have been charged with common offences such as assault or drink driving what the likely result will be if they enter a plea of “Guilty”.
