Domestic AVO

An Apprehended Domestic Violence Orders (ADVOs) is primarily made when there exists a domestic relationship between the victim and the defendant.

i)          Definition of domestic relationship

A domestic relationship includes the following:

  1. A current or former spouse; or
  2. A current or former defacto partner; or
  3. Where you have had an intimate relationship with the victim; or
  4. Where you live or lived with the victim; or
  5. Where you are or have been a relative of the victim.
Please note that same sex relationships are also covered within this definition.
 
ii)         Definition of relative
 
A relative includes the following:
  1. a father, mother, grandmother, grandfather, step-father, step-mother, father-in-law or mother-in-law;
  2. a son, daughter, grandson, grand-daughter, step-son, step-daughter, son-in-law or daughter-in-law;
  3. a brother, sister, half-brother, half-sister, brother-in-law or sister-in-law;
  4. an uncle, aunt, uncle-in-law or aunt-in-law;
  5. nephew or niece; and
  6. Cousin.
