International Tax Law

Businesses operating across country borders need to take into account the taxation laws of all the countries they are located in.

If your company operates in multiple countries, or if you have funds located in off-shore tax havens, it is crucial that you get qualified, experienced legal advice. LAC Lawyers has a team of 5 lawyers who focus on taxation matters, and combine their experience in dealing with the Tax Commissioner & the Australian Tax Office with the knowledge attained through defending criminal matters. Call today on 1300 799 888 (Sydney) or 1300 734 638 (Melbourne).

Overseas-Based Employees

Prior to 2009, the foreign employment income of Australians working overseas was mostly exempt from Australian income tax. This is no longer the case.

Under the current system, Australians working overseas must include their foreign employment income as part of their assessable income in their Australian tax return. To prevent the taxpayer from being taxed twice, the ATO offers a Foreign Income Tax Offest (FITO) for the foreign income tax paid.

For more information on overseas taxation of employees, read our Taxation of Overseas Based Employees article or call today on 1300 799 888 (Sydney) or 1300 734 638 (Melbourne).

Vanuatu and Other Tax Havens

Many Australian taxpayers use overseas tax havens to hide their wealth from the Australian Taxation Office. Vanuatu, in particular, is an attractive tax haven for Australians for a number of reasons, including its proximity, its English-speaking common law system, and official languages of English and French. While this is nothing new, the ATO has begun to focus on Vanuatu and the Cook Islands as places of great interest.

Ultimately, any scheme designed to hide income from the ATO is illegal, and penalties for tax fraud cases can range up to 25 years imprisonment. To learn more, read our article on Vanuatu and the Use of Overseas Tax Havens. tIf you are afraid that you may have committed tax fraud, it is crucial that you speak to a taxation lawyer as soon as possible. Call LAC Lawyers today on 1300 799 888 (Sydney) or 1300 734 638 (Melbourne).

Voluntary Disclosure

In many cases, taxpayers are encouraged to prepare their own voluntary disclosures to save money on professional fees. This can be a dangerous activity - any person who does so is not legally qualified and risks making admissions that can be unfavourable to them in the future.

Currently, there are initiatives active in South Africa and the United States offering reduced penalties where people come forward. If you have failed to comply with the taxation laws in either of these locations, it is crucial that you speak to a taxation lawyer as soon as possible to try and arrange a voluntary disclosure. Call LAC Lawyers today on 1300 799 888 (Sydney) or 1300 734 638 (Melbourne) for advice and information.
