Privacy

Privacy has been a developing area ever since the Privacy Act 1988 as amended by the Privacy Amendment (Private Sector) Act 2000 came into effect. On 21st December 2001 the information, collection, use, disclosure and storage of personal and sensitive information of individuals has become regulated for many businesses in the private sector. It is essential that where private information is being collected that companies have a Privacy Policy which will address the collection, disclosure, security, access and correction of this.

Both companies and individuals may require advice on privacy. Companies need contractual and transactional information reviewed to properly advise them. With individuals it is the nature of the complaint based on the type of information which has been collected, used and disclosed which is important. Our services include the following:

  • Advice on privacy
  • Dealing with privacy statements, consents and policies
  • Drafting and negotiating contractual protections
  • Privacy audits
  • Litigation and Prosecution
  • The effect of Privacy Legislation and codes
  • Training and compliance

The impact of privacy legislation is particularly felt in the credit, health, insurance and telecommunication industries.

In a recent High Court decision, the court recognised for the first time the new common law tort of invasion of privacy. The Chief Justice laid down what was “a useful practice test of what is private.” This has important consequences for the whole area of privacy. Further changes are imminent in the private and public sector health areas in NSW and elsewhere.
