SMSF and their Basic Requirements

Basic requirements of a self-managed superannuation fund (SMSF)

An SMSF is designed to be small in scale and suited to low numbers of individuals, particularly members of the same family. The maximum number of individuals permitted to be involved in an SMSF is five. These five persons must be:

  • the only members and the only trustees of the SMSF; or
  • the only members and the only directors of the corporate trustee of the SMSF.

The SMSF must be set up by the execution of a trust deed. The trust deed ought to be worded carefully in order to safeguard against scrutiny, for example by clearly stating the sole purpose of the trust.

At LAC Lawyers we can draft an SMSF deed so as to ensure that the requirements of the SMSF rules are met. Call LAC today on 1300 799 888 (Sydney) or 1300 734 638 (Melbourne).
