Sexual Assault

Sexual assault is a serious crime and is defined to mean sexual crimes against an individual. It involves the unwanted touching of a person’s body. The victim of sexual assault is not at fault. Sexual assault occurs when a person is unable to or des not give consent. When one has been sexually assaulted the first thing to do is to go to the police who’s primary concern is to protect the victim. There are other forms of assistance that are also available to the victim.

Acts generally classified as sexual assault are un-consented sexual intercourse, indecent assault and acts of indecency. The victim of sexual assault can suffer severe and long term effects. Very often the victim knows the person who has assaulted them. A victim of sexual assault can sue in the civil courts as assault is also tort. Therefore the victim can sue the guilty person in the civil courts for damages. The guilty person can be dealt with either summarily (local court) or by indictment (District Court before Judge and Jury) the former being the more favourable.

When the matter is reported to the police the matters proceeds in the criminal courts. There are instances where the victim does not report to the police and can go straight to the courts. In these instances, the victim must provide sufficient evidence of the wrong doing. The victim need to provide evidence of the injury sustained and this includes actual physical harm as well as psychological or psychiatric harm. This can be in the form of a statutory declaration by someone with knowledge of the assault or a medical practitioner, medical report and hospital records. The Victims Services Approved Counsellor’s report can support a claim. All evidence should be provided to the assessor to understand the extent of the assault against you and make an appropriate award to you.

Depending on which category of the offence the victim proceeds, if the guilty person is convicted in the criminal court they can receive an award in the civil courts.
