Speeding Offences

Penalties for speeding offences can be small compared to other driving charges. These penalties can quickly get more serious, however, if you were over the speed limit by a large amount.

Note that the penalties for speeding offences have recently changed. Even though some speeding offences result in a suspension, in some circumstances there may be avenues for appeal to avoid or reduce a license suspension.

Fines and demerit points

Current penalties for speeding offences for standard light vehicles are:

Exceeding the speed limit by 10km/h or less:

Demerit points (full licence) 1 (or 2 if in a school zone)
Demerit points (L, P1 or P2) 4 (or 5 if in a school zone)
Fine $90 (or $150 if in a school zone)
Minimum suspension Nil
Habitual offender list No

Exceeding the speed limit by 11km/h to 20km/h:

Demerit points (full licence) 3 (or 4 if in a school zone)
Demerit points (L, P1 or P2) 4 (or 5 if in a school zone)
Fine $211 (or $271 if in a school zone)
Minimum suspension Nil
Habitual offender list No

Exceeding the speed limit by 21km/h to 30km/h:

Demerit points (full licence) 4 (or 5 if in a school zone)
Demerit points (L, P1 or P2) 4 (or 5 if in a school zone)
Fine $361 (or $451 if in a school zone)
Minimum suspension Nil
Habitual offender list No

Exceeding the speed limit by 31km/h to 45km/h:

Demerit points (full licence) 5 (or 6 if in a school zone)
Demerit points (L, P1 or P2) 5 (or 6 if in a school zone)
Fine $692 (or $872 if in a school zone)
Minimum suspension 3 months
Habitual offender list No

Exceeding the speed limit by more than 45km/h:

Demerit points (full licence) 6 (or 7 if in a school zone)
Demerit points (L, P1 or P2) 6 (or 7 if in a school zone)
Fine $1,865 (or $1,987 if in a school zone)
Minimum suspension 6 months
Habitual offender list Yes

Note that high-range speeding offences may also result in other stand-alone charges such as dangerous driving or street racing.

Loss of license for excessive speeding

Automatic disqualification period apply for speeding more than 30km/h over the limit (even if the speeding does not result in a loss of points which causes you to exceed the allowable number of points over a three year period). Applicable suspension periods are:-

  • Speeding over 30km/h but less than 45km/h: 3 months disqualification;
  • Speeding over 45km/h: 6 months disqualification.

High-range speeding offences may also result in other stand-alone charges such as dangerous driving or street racing.

Speeding more than 45kh/h over the speed limit is an offence on the habitual offender list, which provides for greater penalties for drivers with three major offences in a five year period.
